  1. In applying for Contractor Access Registration and thereby gaining access to the Estate as defined in the Statutes of the Mooikloof Owners’ Association NPC (“MOA”), I declare that I enter the Estate at my own risk and indemnify the MOA, its directors, employees, contractors and/or consultants against any claim and/or all and any actions of whatsoever nature which may result from my entering and/or working in the Estate.
  2. I agree to abide by the Statutes of the MOA.
  3. I give my consent to the MOA to collect, store and process my personal information.
  4. I give my consent for my ingress and egress records to be shared with the owner of the property.
  5. The MOA is committed to protecting your privacy and ensuring that your Personal Information is collected and used properly, lawfully, and openly for the following purpose: Contractor Access Application, Ingress and Egress Records.
  6. The MOA confirms that your Personal Information collected will be used and disposed of as is required by the Protection of Personal Information Act No. 4 of 2013 (POPI Act).
  7. A signed letter/email written by the owner of the property where the contractor will be working must be attached to this application and a description and duration of the project/work done included. No registrations will be processed without the aforesaid letter.
  8. The building times are as follows:
    1. Mondays to Fridays: 06:30 to 17:00. The contractor’s gate will open at 06:30 and close at 17:30 and will close at 17:00 for deliveries to building sites.
    2. Saturdays: 07:30 to 12:30. The contractor’s gate will open at 07:00 and close at 13:00 and will close at noon for deliveries to building sites.
    3. Sundays and Public Holidays: No contractors or deliveries will be permitted.
  9. No contractors, guards or any workers are allowed to overnight on a building site and no exceptions to this rule can be made.
  10. Contractor workers must be transported to and from the building site and are not allowed to leave the site during the day.
  11. Contract workers may not be dropped off alongside the road.
  12. Contract workers can only gain access to the Estate through the contractor’s entrance at the Atterbury Road entrance. It is also the only exit route for all contract workers.
  13. Infringements as mentioned above the MOA reserves the right to apply the following sanctions at the exclusive discretion of the Mooikloof Estate Manager, which authority the Estate Manager can delegate to the Mooikloof Security Manager.
    1. Imposing a penalty (fine).
    2. Denying access to Mooikloof.
    3. Ban on entering Mooikloof again – blacklist.
    4. Cancelling access.
    5. Instructing the owner/main contractor to end the contract of the contractor or sub-contractor depending on the case.
    6. The owner/contractor has the right to, through the Mooikloof Estate Manager, make representations regarding the penalty sanction to the Board of Directors. The decision of the Board is final and binding. Until the Board considers such representations, the penalty sanction is valid and enforceable.
  14. Only an original ID Book / Passport / Driver’s License / Asylum Document / Permit are accepted for Contractor Access Registration.
  15. A copy of the ID Book / Passport / Driver’s License / Asylum Document / Permit must be attached to the application form.
  16. A copy of the applicant’s driver’s license may be requested.
  17. The fee for access registration is R50.00 (subject to change without notice). Photocopies will be charged at R5.00 per page.
  18. Contractor registrations will strictly only be processed from Monday to Friday.
  19. Re-registration must be done annually in January and the respective access reregistration fee of R50.00 to be paid.
  20. Re-registration will only be processed for companies/contractors after the respective owner has confirmed this in writing to the MOA at info@mooikloofestate.co.za.
  21. Access of two (2) months will be granted whereafter a Contractor Extension Form must be completed to renew access to the Estate. A fee will not be charged for this.
  22. Contractor Extension Forms must be signed by the owner and the supervisor/manager of the company. In cases where the contractor is working at a new address, a signed letter/email written by the owner of the property where the contractor will be working must be attached to the Contractor Extension Form, a description and duration of the project/work done included. No Contractor Extensions will be processed without the aforesaid letter.
